01 Agreement to terms

These Terms of Service (the “Terms”) form a binding agreement between you and Earth United Ventures B.V., a private limited company (besloten vennootschap) incorporated under the laws of the Netherlands with registered office at Keizersgracht 555, 1017 DR Amsterdam, Netherlands (“Earth United”, “we”, “us”, “our”), governing your access to and use of the EcoDesign web application, related websites, APIs, and services (collectively, the “Service”).

By creating an account, accessing the Service, or clicking “I agree” during signup, you confirm that you have read, understood, and accepted these Terms and our Privacy Policy. If you do not agree, do not use the Service.

You must be at least 16 years old to use the Service. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

02 The EcoDesign service

EcoDesign is an AI-assisted ecological design platform that helps users plan and visualize regenerative projects, including but not limited to:

  • Site analysis (climate, soil, topography, hydrology, vegetation)
  • Passive solar building floor-plan generation
  • Plant guild design and visualization
  • Permaculture project planning and conversational AI agents
  • The Farmer Hub module: pest triage, weather alerts, irrigation scheduling, soil insight, transition coaching, and crop planning

We may add, modify, or remove features over time. We will give you reasonable notice of material changes that adversely affect paid features.

03 Your account

To access most features you must create an account by providing accurate name, email, and password information. You are responsible for:

  • Maintaining the confidentiality of your password
  • All activity occurring under your account
  • Notifying us promptly of unauthorized access at info@earthunited.eco

One person may not maintain multiple accounts to circumvent free-credit allocations or subscription limits. We may suspend accounts that appear to be duplicates.

04 AI credits & one-time purchases

The Service uses an AI credit system. AI agents and certain features deduct credits per request. New accounts receive complimentary signup credits as a free trial. Additional credits and project capabilities can be purchased as one-time products:

Prices are shown in Euro (EUR) and are exclusive of any applicable VAT or other taxes, which will be added at checkout where required by law. We may change prices for future purchases at any time; price changes will not affect purchases you have already completed.

Credits do not expire while your account remains active and in good standing, except as set out in the “Termination” section below. Credits have no monetary value, are non-refundable once consumed by an AI request, and cannot be exchanged or transferred between accounts.

05 Farmer Hub subscription

The Farmer Hub is an optional subscription module providing access to farming-focused AI tools. Subscriptions are billed in advance through Stripe.

How subscription credits work

  • You receive 150 farmer credits at the start of each billing cycle.
  • Unused subscription credits roll over up to a maximum balance of 300 credits; any further accumulation is forfeited.
  • When you make an AI request inside the Farmer Hub, subscription credits are consumed first, before any one-time purchased credits.
  • If your subscription is cancelled or lapses, remaining subscription credits expire at the end of the paid period.

Free trial

The 30-day free trial requires a valid payment method but is not charged until the trial ends. You may cancel at any time during the trial without charge from your account settings. After the trial ends, the plan you selected will renew automatically at the price shown above.

Auto-renewal

Subscriptions automatically renew at the end of each billing cycle (monthly or annually) at the then-current price. You may cancel auto-renewal at any time; cancellation takes effect at the end of the current paid period, and you retain access to subscription features until then.

06 Payments & billing

All payments are processed by Stripe Payments Europe, Ltd. We do not store full payment card details on our servers. By providing payment information, you authorize Stripe and us to charge the chosen amount to your selected payment method.

If a charge fails (for example, an expired card or insufficient funds), we may retry the charge through Stripe in line with Stripe’s standard dunning process. Failure to maintain a valid payment method may result in suspension of subscription access.

Receipts are sent to the email address on your account after each successful charge.

07 Refunds & cancellation

EU consumer right of withdrawal

If you are a consumer in the European Union, you generally have a 14-day right of withdrawal under Directive 2011/83/EU. By starting to use the Service, downloading any AI-generated content, or consuming any AI credits, you expressly request that performance begin during the withdrawal period and acknowledge that you will lose the right of withdrawal once the digital service has been fully performed.

Subscriptions

You may cancel a subscription at any time. Cancellation stops future renewals; we do not provide pro-rata refunds for partially used billing cycles, except where required by applicable law. The 30-day free trial may be cancelled at any time during the trial without charge.

One-time purchases

One-time credit and capability purchases are non-refundable once any portion of the credits has been consumed or once the unlocked capability has been used to generate output. If you have not used any portion of a purchase, you may request a refund within 14 days of purchase by emailing info@earthunited.eco.

08 AI-generated content

Important: EcoDesign output is design assistance, not professional advice. Floor plans, building visualizations, plant guilds, soil interpretations, irrigation schedules, pest recommendations, and other AI-generated content are produced by automated systems and may contain errors, omissions, or unsuitable suggestions. You are solely responsible for verifying any output with qualified professionals (architects, structural engineers, agronomists, licensed pesticide advisors, certified arborists, etc.) before relying on it for construction, planting, pest treatment, or any decision with safety, financial, regulatory, or ecological consequences.

Compliance with local laws

Building plans, planting schemes, water-use recommendations, and pest interventions generated by the Service do not account for local building codes, zoning laws, conservation regulations, biosecurity restrictions, pesticide registration regimes, or protected-species rules. You are responsible for ensuring that any action you take based on Service output complies with all applicable laws and regulations in your jurisdiction.

Ownership of AI output

Subject to your compliance with these Terms and payment of any applicable fees, you own the AI-generated outputs created from your inputs. We do not claim ownership of plans, visualizations, or other outputs generated for your project. We may, however, retain non-personal usage data to improve the Service.

09 Your content

You retain ownership of all data, photos, project descriptions, and other content you upload to the Service (“Your Content”). By uploading Your Content you grant us a worldwide, non-exclusive, royalty-free licence to host, store, process, transmit, and display Your Content solely as necessary to provide the Service to you.

You represent and warrant that you have the rights necessary to grant this licence and that Your Content does not infringe any third-party rights or applicable laws.

10 Acceptable use

You agree not to use the Service to:

  • Violate any law, regulation, or third-party right
  • Upload malicious code, attempt to disrupt the Service, or probe its security
  • Reverse-engineer, scrape, or systematically extract data from the Service except via APIs we expressly provide
  • Resell, sub-license, or otherwise commercially exploit credits, subscriptions, or AI outputs except as permitted in these Terms
  • Submit content depicting violence, hate speech, sexual content involving minors, or otherwise unlawful material
  • Use the Service to generate plans, recommendations, or interventions intended to cause ecological harm, deploy invasive species deliberately, or circumvent biosecurity controls
  • Bypass credit limits, rate limits, or subscription tiers through technical means or multiple accounts

11 Third-party services

The Service relies on third-party providers to deliver certain features. Your use of the Service is also subject to the terms of these providers where applicable. Current providers include:

  • OpenAI, Anthropic, Google, and Perplexity — large language and image-generation models for AI agents and visualizations
  • Stripe — payment processing
  • Open-Meteo — weather and climate data
  • Kindwise — plant disease and pest identification from photos
  • ISRIC SoilGrids — global soil reference data
  • Vercel — hosting infrastructure
  • MapTiler / Leaflet — mapping

We are not responsible for the availability, accuracy, or terms of third-party services. Outages or changes by third parties may affect Service functionality.

12 Intellectual property

The Service, including its software, design, branding, agricultural component databases, AI agent prompts and orchestration, and underlying methodologies, is owned by Earth United Ventures B.V. and protected by copyright, trademark, and other intellectual property laws. Except for the limited rights expressly granted in these Terms, no rights are transferred to you.

“Earth United”, “EcoDesign”, and the leaf-mark logo are trademarks of Earth United Ventures B.V. You may not use them without our prior written consent.

13 Disclaimers

To the fullest extent permitted by law, the Service is provided “as is” and “as available”, without warranties of any kind, whether express, implied, statutory, or otherwise, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement.

We do not warrant that:

  • The Service will be uninterrupted, secure, or error-free
  • AI-generated outputs will be accurate, complete, suitable, safe, or compliant with any specific regulation
  • External data sources (weather, soil, plant identification) will be available or correct at any given time
  • The Service will meet your specific design, agricultural, or business requirements

14 Limitation of liability

To the maximum extent permitted by law, in no event shall Earth United Ventures B.V., its directors, officers, employees, contractors, shareholders, or affiliates be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including without limitation lost profits, lost revenue, lost data, lost crops, structural failures, ecological harm, or business interruption, arising out of or related to your use of the Service.

Our total aggregate liability to you for any claim arising out of or related to these Terms or the Service shall not exceed the greater of (a) the total amounts you paid to us for the Service in the twelve (12) months preceding the event giving rise to liability, or (b) one hundred Euro (€100).

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law (including liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation).

15 Suspension & termination

You may close your account at any time by emailing info@earthunited.eco. We may suspend or terminate your account, with or without notice, if we reasonably believe you have breached these Terms, your account is being used fraudulently, or continued service would expose us to legal risk.

On termination: (a) your right to access the Service ends immediately; (b) any unused credits and subscription credits are forfeited; (c) we may delete account data after a reasonable retention period as described in our Privacy Policy; (d) sections that by their nature should survive termination (including IP, disclaimers, liability limits, and governing law) will continue to apply.

16 Changes to these terms

We may update these Terms from time to time. If changes are material, we will notify you by email or via an in-app notice at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms. If you do not agree to the changes, you should stop using the Service and may close your account.

17 Governing law & jurisdiction

These Terms and any non-contractual obligations arising out of or in connection with them are governed by the laws of the Netherlands, excluding the United Nations Convention on Contracts for the International Sale of Goods and without regard to conflict-of-law principles.

Any dispute arising out of or in connection with these Terms or the Service shall be submitted to the exclusive jurisdiction of the competent courts of Amsterdam, the Netherlands, save that:

  • If you are a consumer habitually resident in the European Union, you may also bring proceedings in the courts of the EU Member State in which you are resident, and mandatory consumer-protection rules of that Member State continue to apply to you regardless of this choice of law;
  • Earth United may bring proceedings against you in the courts of your country of residence where required by applicable law.

EU online dispute resolution

If you are a consumer in the EU, you may also use the European Commission’s online dispute resolution platform at ec.europa.eu/consumers/odr. We are not, however, obliged to participate in alternative dispute-resolution procedures before a consumer arbitration board.
